(a) The steady rate of climb must be determined --

(1) With maximum continuous power;

(2) With the landing gear retracted; and

(3) At Vy for standard sea level conditions and at speeds selected by the applicant for other conditions.

(b) For each Category B rotorcraft except helicopters, the rate of climb determined under paragraph (a) of this section must provide a steady climb gradient of at least 1:6 under standard sea level conditions. (Secs. 313(a), 601, 603, 604, and 605 of the Federal Aviation Act of 1958 (49 U.S.C. 1354(a), 1421, 1423, 1424, and 1425); and sec. 6(c), Dept. of Transportation Act (49 U.S.C. 1655(c)))
